Terms and Conditions

Navmapstore.com is one of the concepts of Navigarde, the company is registered in the Chamber of Commerce in Venlo, The Netherlands, register number 87397188. Navigarde is a registered trade mark under register number 1049662.

Article 1: General Conditions

  1. 1.1. These sale conditions are created by Navigarde in Enkhuizen (further referred to as Navigarde) and are applicable to any sale concluded through Navigarde´s website or through written or oral agreement.
  2. 1.2. Any exceptions and/or additions to the present sale conditions are valid exclusively insofar as they are agreed to in writing by Navigarde, in which case the remainder of the sale conditions remain in force.
  3. 1.3. With the use of Navigarde`s website and/or the placing of an order, the Buyer assumes these general sale conditions as well as all the other rights and obligations as they are described in the website.
  4. 1.4. Navigarde is authorised to make use of a third party in carrying out an agreement with the Buyer.

Article 2: Orders and returns

  1. 2.1. An agreement comes into place at the moment when an order confirmation is sent to the Buyer´s (email) address, accordingly indicated by the Buyer.
  2. 2.2. Buyer and Navigarde expressly agree that through the use of electronic means of communication a valid agreement comes into place. The lack of a signature does not diminish or cancel in any way the binding force of the offer and its acceptance.
  3. 2.3. Navigarde shall deliver the purchased products immediately after duly having receipt of the order and the respective payment, unless other arrangements have been made. Any other specified delivery times are not to be regarded as a deadline.
  4. 2.4. Navigarde has the right to cancel the order by written notice to the Buyer, in case of failing delivery from its suppliers.
  5. 2.5. The customer has the right to withdraw from this agreement within fourteen days without stating any reasons. The customer must inform Navigarde of his/her decision to withdraw from this agreement by means of a clear statement and may use the withdrawal form attached to the order confirmation. The withdrawal period is fourteen days from the date on which the customer took the first consignment of goods into possession. The customer is responsible for the direct costs of the return of the goods. Navigarde is obliged to reimburse all payments, including delivery costs, immediately and at the latest within fourteen days. For this repayment Navigarde will use the same method of payment which the customer used for the original transaction, unless something different is explicitly agreed between the two parties. Navigarde may refuse this repayment until it received the returned goods or until the customer provided evidence that the goods were returned, whichever of these occurs first.

    Goods must be returned immediately, and in any case at the latest within fourteen days from the date on which the cutomer informs Navigarde of the withdrawal from this agreement.
  6. 2.6. Accordance with European legislation, navigation software which is unsealed or activated is excluded from the right of withdrawal.
  7. 2.7. Also no refund is possible for goods specially ordered by and produced for the customer.
  8. 2.8. Goods sent to the customer are insured. If damage should occur, it must be reported to Navigarde within 24 hours of receipt. Messages entering later can not be processed. Navigarde will directly replace the damaged goods for new ones, if possible, at no cost to the recipient. Notification of damage must at all times be reported immediately upon receipt to the carrier, otherwise no redress is possible.
  9. 2.9. The customer can cancel the order before it has been sent out, with no cancelation costs. The amount is within 3 working refunded without deduction of the costs. If the goods were already sent, see under 2.5.

Article 3: Validity

  1. 3.1. Offers are valid as long as they appear in the website and/or as long as stocks are available.
  2. 3.2. Information, images, communications, weather oral, by telephone, by email, via fax or otherwise statements etc. with regard to all the offers and the main characteristics of the products are as accurately as possible indicated or done. Having into account that Navigarde is in most cases dependent on the information given by her suppliers, Navigarde can not guarantee that all the offers and products are completely in conformity with the given information. deviations to the information given cannot in principle give rise to damage compensation or/and to cancellation.

Article 4: Prices and remaining conditions

  1. 4.1. All the prices are inclusive taxes, unless otherwise explicitely indicated.
  2. 4.2. Prices as mentioned are the valid prices at that moment. They can be changed without further notice. From the moment that orders are confirmed with their respective prices and conditions, those prices are then fixed.
  3. 4.3. Special offers are valid only for the validity period indicated by the offer.
  4. 4.4. Quotes for the mounting of navigation systems are always exclusive eventual special facilities for the car, like the so-called API's, Canbus Interfaces, recessed windows, special supports and other facilities.
  5. 4.5. Payments to Navigarde in connection with any contract to which these conditions apply, must be made in euros without any deductions. Payments should be preferably made to the Navigarde's bank account at Rabobank, IBAN: NL48 RABO 0141 4775 71, BIC: RABONL2U
  6. 4.6. Shipping costs are, unless otherwise specified, not included in the price. Special rates apply to shipping outside The Netherlands. Shipping costs are indicated at the website. Navigarde, By conclusion of the agreement with the Buyer, includes the shipping costs in the Buyer's account. For certain payment methods other conditions may apply, depending on the shipping methods and the costs to it associated. in this case, the Buyer will be informed.
  7. 4.7. The Buyer must pay to Navigarde the total purchase price including shipping costs immediately after receipt of confirmation. If payment does not occur within 14 days the Buyer is leggally obligated to pay to Navigarde, without need of notification thereof, interest over the unpaid amount, as well as extrajudicial collection costs amounting to 15% of the principal amount provided that these costs amount to at least 34 euros exclusive taxes.
  8. 4.8. The goods remain property of Navigarde until they are payed in full by the Buyer. Selling these goods before total payment takes place is not allowed. If the Buyer fails to pay, Navigarde is entitled to collect, at the expense of the Buyer, the goods of which it has ownership.

Article 5: Guarantee and information

  1. 5.1. If applicable, the guarantee terms and conditions apply to the Navigarde delivered items. This is the guarantee as determined by the producer or the importer of the products. The customer may for any guarantee claims contact the producer or use the service addresses indicated by the producer. The costs of transportation of a returned and repaired item to the customer are borne by the supplier. If investigation shows that the resulting defect is caused by incorrect or improper use, it will not be eligible for guarantee and the investigation costs may be charged.
  2. 5.2. Notwithstanding the provisions of this article, you can not use the guarantee to obtain the following damage: broken screens; damage due to improper use, humidity or water damage; for consumables (batteries, LCD / TFT back light, car chargers, home chargers etc.); in case of changes to this article, including repairs not permitted by Navigarde or the producer; where defects are the result of the article being improperly used or used not in correspondence with its object; if damage to the product is caused by intent, gross negligence or negligent maintenance on the part of the Buyer; For navigation systems the guarantee is void if use is made of pirated CDs.
  3. 5.3. Navigation systems are dependent on a number of external factors, such as GPS signals and land software: Navigarde is not responsible for incorrect operations due to situations where the receiving GPS signals is not possible, such as in tunnels, narrow streets, bridges, narrow mountain passes or failure in sending the signals from the satellites. Navigarde is not responsible for the lack of streets or other data encoding which might lead to calculating a wrong route, or other external causes. In systems with fixed installation navigation systems are dependent on external signals in the car, such as the so-called speed pulse or tacho pulse and the electrical circuit in the car, that with each car brand, model and year may differ. Navigarde is not responsible for this. For some cars special so called APIs are necessary or Can Bus Interfaces. Navigarde is not responsible for the proper functioning in combination with the external signals of the vehicle. Even if the systems are built by Navigarde.
  4. 5.4. If Navigarde, for whatever reason, is obliged to compensate any damage, this will not exceed an amount equal to the invoice value of the product and / or service which caused the damage.
  5. 5.5. The Buyer is obliged to indemnify Navigarde of any third-party claims against Navigarde in respect to the implementation of the agreement.
  6. 5.6. The information on the website is regularly updated and / or amended. Navigarde reserves the right to make any changes with immediate effect and without prior announcement.
  7. 5.7. The content of the website and the contents of all other manifestations of Navigarde on the Internet, is elaborated with the greatest care. Navigarde can not give guarantees concerning the nature, accuracy or content of that information. Navigarde is not liable for any errors, inaccuracies, misunderstandings, delays or illegible orders and messages resulting from the use of the Internet or any other (electronic) means of communication in the communication between the Buyer and Navigarde or for the consequences of using the information. Navigarde furthermore excludes all liability in respect of its advice or answers to questions.
  8. 5.8. It is possible that Navigarde on its website refers to links to other web sites that may be interesting or informative for the visitor. Such links are purely informative. Navigarde is not responsible for the content of the web sites referred to or the use that can be made.
  9. 5.9. In case of force majeure, Navigarde is not obliged to keep its obligations to the Buyer, for the duration of the force majeure. Force majeure shall mean any circumstance beyond its control, thus preventing its obligations towards the Buyer from being fully or partially fulfilled. These circumstances include strikes, fires, business disturbances, power failures, non or late delivery by suppliers or other third parties and the absence of any government issued license. Force majeure also includes failures in (telecommunications) networks or connections or communications and / or at any time non availability of the website.
  10. 5.10. Notwithstanding the other provisions of these terms and conditions, Navigarde on its part will not be liable for damages that remain in the responsibility of the Buyer, nor will Navigarde, unless intent or gross negligence on its part, be liable for: damage caused by delay in delivery of the purchased items, profits consequential damages, including damages which is the result of acting in accordance with descriptions, explanations, notices or instructions given in the instructions provided by the supplier.
  11. 5.11. The Buyer shall indemnify Navigarde against all third party claims for damages related to Navigarde deliveries.

Article 6: Intelectual property

  1. 6.1. The Buyer acknowledges that all intellectual property rights to the information, communications or other expressions with respect to the products and / or with respect to the website belong to Navigarde, its suppliers or other claimants.
  2. 6.2. Intellectual property includes patents, copyrights, trademarks, designs and design rights and / or other (intellectual) property rights, also including sui generis right to databases or other productions, and, though not patentable, technical and / or commercial know-how, methods and concepts.
  3. 6.3. The Buyer is not permitted to use (also including making changes) of intellectual property rights as described in this article, such as reproduction, without the express prior written consent of Navigarde, its suppliers or other claimants unless it is for private use in relation to the product itself.
  4. 6.4. Navigarde declares that to the best of its knowledge it does not infringe rights applicable in the Netherlands as regards the intellectual property of others. If an action for an infringement of such rights is filed or if the possibility exists, Navigarde may choose to include a replacement or a modification of the brand or of a product, or to acquire the right to continue to use that brand or product, or to terminate the contract in whole or in part under refund to the Buyer of the price paid for by the item, if necessary, less a reasonable amount to depreciation.
  5. 6.5. The website, layout, texts, photos and all other parts of the website, with the exception of certain links, are property of Navigarde. It is not permitted to use the website or parts of it in public, copy or save it without explicit written permission of Navigarde. This authorisation is not required for personal, non commercial use.

Article 7: Personal data and privacy

  1. 7.1. Navigarde shall make use of the details of the Buyer exclusively in accordance with its privacy policy and it will observe the applicable privacy laws and regulations.
  2. 7.2. When the Buyer visits the web site and places an order, various data are collected so that an optimal service can be offered to the Buyer. Navigarde attaches great importance to the Buyer´s personal data to remain secure and confidential
  3. 7.3. The data of the Buyer are registered by Navigarde in a database,that in accordance with the Data Protection Act can exclusively be used for communication with its customers.
  4. 7.4. The website may contain advertising of third parties or links to other sites. In the privacy policies of these third party or their sites has Navigarde no effect in and is therefore not liable.
  5. 7.5. The Buyer is free to ask Navigarde which of his data have been processed. The Buyer has the right to access and correct his data. If the Buyer wishes to see his data from the database, he may indicate so in writing by post or e-mail. Changes are immediately entered and processed

Article 8: Changes

  1. 8.1. Navigarde reserves itself the right to introduce changes to these terms and conditions.

Article 9: Final provisions

  1. 9.1. The Netherlands' law applies to all deliveries by Navigarde, with the exclusion of the CISG
  2. 9.2. Eventual disputes between the Buyer and Navigarde shall initially be submitted exclusively to the competent court in Amsterdam, unless pursuant to a statutory provision of mandatory law that is prohibited.
  3. 9.3. Navigarde will if desired take back the discarded products, when a new purchase was made in return.
  4. 9.4. Collection or return of products is possible everyday with a previous appointment, at our adress in The Netherlands. Contact is possible 24 hours a day via the email address info@navigarde.nl and telephone contact is possible from monday to friday between 08.30 am and 06.00 pm via the local telephone numbers.
  5. 9.5. You can send complaints via email to info@navigarde.nl; this is the most efficient way for us to answer you as quickly as possible. You will recieve a reaction within 48 hours. You can also write a letter to: Navigarde, John F. Kennedylaan 224, 5981 WX Panningen, The Netherlands.
